End User License Agreement.

The license that lets you install and use the Pogama desktop app on your computers.

This document was written to describe how Pogama actually works and to meet the laws of the EU, the United States and Uruguay. If something is unclear, write to soporte@pogama.xyz.

1. What this agreement covers

This End User License Agreement (“EULA”) is between you and GS Team 2026 and covers the Pogama desktop app, its installer and the updates we provide for it (the “Software”). Parts of the Software that are open source — including the parts of the installer derived from BetterDiscord Installer — are licensed under their own licenses. It is part of the Terms of Service: the Terms cover your account and the online Service, and this EULA covers the Software on your computer. By installing or using the Software you accept this EULA.

2. Your license

We grant you a personal, worldwide, non-exclusive, non-transferable and revocable license to install and use the Software on computers you own or control, for your personal use or for your work, including the internal work of your organization.

Free features are available to every user. Features of a paid plan (Pro or Max) are available while a valid license for that plan is active on your account; the Software checks the license on your device. The Software is licensed, not sold: we and our licensors keep all rights not expressly granted.

3. What you may not do

Except where the law expressly allows it despite this restriction, you may not:

  • copy, modify, adapt or create derivative works of the Software, other than the copies needed to install it, run it and back it up;
  • decompile, disassemble or reverse engineer the Software, except to the extent the applicable law allows (for example, to achieve interoperability under EU law);
  • remove or alter notices of ownership, licenses or credits, including “App developed by Pocho.dev”;
  • bypass, disable or tamper with license checks, plan limits, permissions, the diff review or other safeguards;
  • rent, lend, sell, sublicense or distribute the Software, or offer it as a hosted service to others;
  • use the Software in breach of the Acceptable Use Policy or the law.

4. The Software on your computer

The Software stores your projects, chats, settings and history on your device, and your API keys in the operating system's credential store. It reads and changes files only inside folders you grant, runs terminals and commands only when you start them or approve them, and asks before sensitive actions according to the permissions you set. You are responsible for what you approve and for keeping backups of important data.

The installer installs Pogama for your Windows user account without administrator rights. Uninstalling removes the installed program files; your data, settings and keys are left in place so you don't lose them by accident, and you can delete them yourself.

5. Updates

We may provide updates that fix problems, improve security or add, change or remove features. When the Software offers an update, it checks before installing that the package matches the expected SHA-256 hash and carries a valid signature made with Pogama's release key; a package that fails either check is discarded and never installed.

The Software doesn't restart on its own to update: you choose “Restart and update”, or to install when you quit. Some online features may require a recent version to keep working safely. If you are a consumer in the EU or EEA, we provide the updates, including security updates, needed to keep the Software in conformity for the period the law requires.

6. Third-party components and services

The Software includes open-source components that are licensed to you under their own licenses, which prevail over this EULA for those components. They are listed, with their licenses, in the open-source notices and in the app's Acknowledgements.

The Software connects to services you choose — AI providers, local model servers, MCP servers, AI command-line tools, browsers, block explorers. Those services are not part of the Software and are governed by their own terms.

7. Ownership

The Software, including its code, design, the Pogama name, logo and the mascot Pocho, belongs to GS Team 2026 or its licensors and is protected by intellectual property laws and international treaties. Your content and the files you work on remain yours.

8. Termination

This license lasts until it ends. You can end it at any time by uninstalling the Software. We can end it if you seriously break this EULA or the Terms of Service, after notice where possible. When it ends, you must stop using the Software and uninstall it; the data on your computer remains yours. Paid features end when the corresponding license expires or is ended under the Terms.

9. Warranty disclaimer

To the extent the law allows, the Software is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the Software will be error-free, that it will detect every threat (Security Lab), or that AI output produced with it will be correct.

This disclaimer doesn't affect your rights as a consumer. If you live in the EU or EEA, the legal guarantee that digital content conforms to the contract applies. If you live in Uruguay, your rights under Ley 17.250 apply. Some US states don't allow the exclusion of implied warranties, so this exclusion may not apply to you.

Limitation of liability, governing law (Uruguay, with your mandatory consumer protections) and disputes are covered in the Terms of Service and apply to this EULA.

10. Export

The Software contains encryption. You may not export or use it in breach of the export control and sanctions laws described in the Terms of Service.
