1. The agreement
These Terms govern your use of Pogama: the desktop app, the website pogama.xyz (including its account area and web chat), the Pogama account, and the online features connected to it (together, the “Service”). By creating an account, installing the app or using the Service, you accept these Terms.
They work together with the Acceptable Use Policy, the End User License Agreement for the desktop app, the Refunds & Cancellation policy and the Copyright policy. How we handle personal data is explained in the Privacy Policy and the Cookie Policy. If a document and these Terms disagree, these Terms win, except where the other document is more protective of you.
If you use Pogama for an organization, you accept these Terms for it and confirm you can bind it; “you” then means both you and that organization.
2. Who we are
Pogama is provided by GS Team 2026 (“Pogama”, “we”, “us”). The app is developed under the brand Pocho.dev. Our contact for everything — questions, legal notices, complaints — is soporte@pogama.xyz. Further identification details are in the Legal notice.
3. Who can use Pogama
You must be at least 16 years old to create a Pogama account or use the Service, everywhere in the world. Pogama is not directed to children, and we do not knowingly collect personal data from anyone under 16 (and never from children under 13). If you believe a child has created an account, write to soporte@pogama.xyz and we will delete it.
You must also be legally able to enter into this agreement and not be barred from using the Service under the laws that apply to you (see “Export controls and sanctions”).
4. Your account
The desktop app asks you to sign in with a Pogama account, and the website's account area uses the same account. You sign up with an email address and a password; we confirm the address with a 6-digit code.
- Give us an email address you control and keep it up to date: we use it for sign-in codes and important account notices.
- Keep your password private and use one you don't use elsewhere. You're responsible for what happens under your account unless it happened because of our failure.
- Tell us at soporte@pogama.xyz as soon as possible if you think someone else has accessed your account.
- One person per account. Don't sell, share or transfer your account.
You can ask us to delete your account at any time by writing to soporte@pogama.xyz. What happens to your data is explained in the Privacy Policy.
5. Plans and licenses
Pogama has three plans: Free, Pro and Max. Free includes the core of the app and has no time limit. Pro and Max add extras, such as deeper reasoning settings, Client Hub and higher daily limits in the web chat; the pricing page shows what each plan includes.
A paid plan is activated with a signed license linked to your account, which the app checks on your device. A license has an expiry date; when it ends, the app returns to Free without deleting your data. We may also grant licenses ourselves, for example for early access or promotions; their duration is shown with the license.
Prices have not been announced and checkout is not open yet: today nobody can be charged for Pogama. When paid plans become available, the price, billing period, renewal and taxes will be shown before you pay, and purchases will be governed by these Terms and the Refunds & Cancellation policy.
Plans control limits that Pogama applies (for example, how long an answer may be or how much reasoning is requested). They don't change what your AI provider charges you or decides; see “Third-party AI providers”.
6. The desktop app
The desktop app is licensed to you, not sold, under the End User License Agreement. It currently runs on Windows. Most of what you do in it stays on your computer: projects, files, chats, history and settings live on your device, and API keys are kept in your operating system's credential store.
The app can read, change or run things on your computer only inside the folders you grant it and, for sensitive actions, only after the permission you set (ask, allow or deny). Changes the AI proposes to your files are shown as a reviewable diff before they are written. You decide what to approve.
7. Your content
Your content is everything you create, upload, write or receive through Pogama: prompts, messages, files, code, tasks, notes and the AI output you get. You keep all rights you have in it. We claim no ownership of your content.
Most content never reaches us: it stays on your device or goes directly from your device to the AI provider you choose. For the features that do store content on our servers — tasks and comments in Work, messages and files in Teams, Client Hub sync records, and your profile — you give us a limited, worldwide, non-exclusive license to store, copy, transmit and display that content only as needed to run those features for you and the people you share it with. The license ends when the content is deleted, except for copies we must keep by law or that others already received from you.
We do not train AI models on your content. Pogama does not develop its own AI models.
You confirm that you have the rights needed for the content you put into Pogama and that sharing it doesn't break the law or anyone's rights.
8. AI output
Pogama connects you to AI models made by other companies. AI output can be wrong, incomplete, out of date, biased or similar to content others receive. It is not professional advice (legal, medical, financial, security or otherwise).
- Review AI output before you rely on it, publish it or run it. Pogama is built so you can: file changes go through a diff review and sensitive actions through permissions.
- Agents, terminal AIs and scheduled runs act with the access you give them. If you allow an AI to edit files or run commands without asking, you are responsible for what it does in your folders.
- Whether you can use, protect or commercialize AI output also depends on the law and on your AI provider's terms.
9. Third-party AI providers and your keys
In the desktop app you choose the AI provider (for example Anthropic, OpenAI, Google, OpenRouter, or a local model through Ollama or LM Studio) and use it with your own account and API key. Those providers are not our subprocessors: your relationship with them is governed by their terms and privacy policies, which apply to what they receive.
- Usage and costs with your provider are between you and them. Pogama shows costs only when they are known, and shows “Unknown” otherwise; your provider's bill is the final word.
- Your API keys are stored in your operating system's credential store and are used only for the provider they were saved for. Keep them safe and revoke them with your provider if you think they were exposed.
- Providers can change, limit or stop their models at any time. We can't guarantee any provider's availability, quality or prices.
The chat on pogama.xyz is different: there, Pogama runs the model for you through Anthropic, with daily limits per plan. We may limit or suspend web chat use that is abusive or that threatens the service for others.
11. Acceptable use
Use Pogama lawfully and respectfully. The Acceptable Use Policy lists what is not allowed, including attacks on systems you are not authorized to test, malware, abuse of other people and attempts to bypass our limits. Breaking it can lead to removal of content, limits on features or termination.
12. Security Lab and Cybersecurity
Security Lab analyzes files, folders and archives locally to help you decide whether to trust them. Its verdict is an aid, not a guarantee: it never says that something is “safe”, and it can miss threats. Use it only on files you own or are authorized to inspect.
The Cybersecurity workspace is for authorized, defensive work only: assessments of systems you own or have written permission to test, within the scope you record. You are responsible for having and keeping that authorization.
13. Crypto wallets
The crypto wallets feature is read-only. It shows balances and movements of public addresses you add, read from public sources or endpoints you configure. Pogama never asks for, stores or uses seed phrases or private keys, cannot move funds and does not provide custody, exchange or payment services.
Balances, prices and histories come from third parties and can be delayed, incomplete or wrong. Nothing in Pogama is financial, investment or tax advice.
14. Our intellectual property
Pogama — the software, its design, the Pogama name and logo, the mascot Pocho, the website and its texts — belongs to GS Team 2026 or its licensors and is protected by intellectual property laws. These Terms and the EULA give you the right to use Pogama; they don't transfer ownership or let you use our name or logo without permission.

15. Feedback
If you send us ideas or suggestions, we may use them to improve Pogama without owing you anything. We won't publish your name or your private content with them without your permission.
16. Availability and changes to the Service
We work to keep Pogama available and to fix problems, but the online parts (accounts, web chat, Work, Teams, Client Hub sync, updates) can be interrupted for maintenance, failures or reasons outside our control. The desktop app keeps working offline for everything that doesn't need those services.
We may add, change or remove features. If a change significantly reduces what a paid plan includes during a period you already paid for, we will tell you in advance and you may cancel and receive a proportional refund of the unused period.
17. Suspension and termination
You can stop using Pogama at any time, uninstall the app and ask us to delete your account.
We may suspend or close an account, or remove content, if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if the law requires it, or to protect people or the Service. Except when it would be unlawful or would put someone at risk, we tell you the reason and how to ask us to reconsider. If we close an account without a reason that is your fault, we refund the unused part of any paid period.
When the agreement ends, the sections that by their nature should continue (such as ownership, disclaimers, limitation of liability and governing law) remain in force. The data on your own computer stays yours and stays there.
18. Disclaimers
We provide Pogama with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that AI output, security findings or crypto data will be accurate.
Keep your own backups of important work. The app includes backup tools, but no software can rule out data loss.
19. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. To the extent the law allows, our total liability for any claim related to the Service is limited to the amount you paid us for Pogama in the 12 months before the claim, or USD 50 if you paid nothing.
We are not responsible for third-party services you choose to use with Pogama (AI providers, MCP servers, CLIs, browsers, block explorers), or for actions you approved.
Your rights as a consumer come first. Nothing in these Terms limits or excludes liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct. If you live in the EU or EEA, you keep your statutory rights, including the legal guarantee that digital content and services conform to the contract. If you live in Uruguay, you keep your rights under Ley 17.250 de Relaciones de Consumo, and no clause here applies to the extent it is abusive under that law. Some US states don't allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so some of the limits above may not apply to you.
20. Indemnity (business users only)
If you use Pogama for a business or organization (not as a consumer), you will defend and compensate us for claims, losses and reasonable costs (including legal fees) brought by third parties that arise from your content, your use of the Service in breach of these Terms or the law, or your infringement of someone else's rights. This section does not apply to consumers.
21. Governing law and disputes
These Terms are governed by the laws of Uruguay, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country or state where you live, and choosing the law of Uruguay does not take that protection away.
Before going to court, please write to soporte@pogama.xyz: most problems can be solved quickly. Disputes are decided by the courts of Uruguay; if you are a consumer, you can also bring a claim in the courts where you live, and we can only sue you there when your law requires it. Nothing in these Terms requires arbitration or waives your right to join a class or collective action where the law grants it.
In Uruguay you can also contact the consumer protection area of the Ministry of Economy and Finance (Área de Defensa del Consumidor). In the EU you can contact your national consumer authority or the European Consumer Centre of your country.
22. Export controls and sanctions
Pogama includes encryption and is subject to export control and sanctions laws, including those of the United States, the European Union, the United Nations and Uruguay. You may not use, export or re-export Pogama to a country, region, person or organization under comprehensive sanctions or on a restricted-party list, or for uses those laws prohibit. By using Pogama you confirm you are not such a person.
23. Changes to these Terms
We may update these Terms when Pogama or the law changes. The date at the top always shows the latest version. For significant changes we will tell you in advance — by email or in the app — and, for paid plans, at least 30 days before they apply to you. If you don't agree, you can stop using Pogama and close your account before the change applies; for a paid plan, you can cancel and receive a proportional refund of the unused period.
24. General
- If a part of these Terms is found invalid, the rest stays in force, and the invalid part is replaced by the valid rule closest to its purpose.
- If we don't enforce a right right away, we don't give it up.
- You can't transfer your rights under these Terms without our consent. We may transfer them to a company that takes over Pogama, with notice to you and without reducing your rights.
- These Terms, with the documents they mention, are the whole agreement between you and us about the Service.
- The English and Spanish versions have the same value. If they differ, the version in your language prevails when you are a consumer.
